1. About these terms

These terms are an agreement between you and Omahalytics ("we", "us"). They apply to the Omahalytics website, the calculator app and every feature in it (together, the "Service").

By creating an account or using the Service you accept these terms. If you do not accept them, do not use the Service. The terms are written in English, and you can save or print this page at any time.

2. The service

Omahalytics is online software for studying Pot Limit Omaha with 4, 5 and 6 hole cards. It ranks every starting hand by preflop equity, simulates multiway range vs range equity with confidence intervals, and builds flop reports and related analysis. The calculations run on our servers; you use the Service in a web browser.

To use it you need an internet connection and a current version of a major browser (Chrome, Edge, Firefox or Safari) with JavaScript and cookies enabled. The Service works on phones and computers; a larger screen makes long reports easier to read.

Omahalytics is an educational tool. It does not offer, organize or take part in gambling of any kind.

3. Your account

• You must be at least 18 years old, and old enough to enter a binding contract where you live. If we learn that an account belongs to someone younger, we close it and delete its data.
• Each account belongs to one natural person. Do not share your login, session or screen with others, and do not create more than one account to get more free use.
• Give accurate details and keep your email address current; we use it for notices about your account and these terms.
• Sign in may be handled by a third party authentication provider. Keep your login secure and tell us at once if you think someone else has used your account.

4. Plans, limits and fair use

The Service comes in plans such as Free and Pro. The features and limits of each plan (for example runs per day, flop reports per month, deals per run and shared links) are shown on the pricing page and in the app. Pro is currently offered to every user at no cost, and no payment details are needed.

To keep the Service fast for everyone, we run one calculation per user at a time, stop runs that are left idle, and apply rate limits and daily quotas. We may adjust limits for technical or capacity reasons. If a change reduces what a paid plan includes, we will tell you in advance and you may cancel with a refund for the unused part of your plan.

Fair use of Pro. Pro is made for one person studying the game, and its limits are set so that such study does not run into them. Pro is subject to fair use: you may not use it in a way that takes far more of our computing capacity than one person's own study needs, for example by keeping calculations running around the clock for days, or by repeating the same long reports over and over. Where a plan offers unlimited runs, they are unlimited for one person's own study, and a single flop report stops after about 200 million deals. If your use is far beyond what one player needs, we will first contact you, and if it continues we may lower your limits or the size of your runs. We will not end a paid plan for this reason without telling you first and refunding the unused part of your plan.

We may start charging for Pro. We will tell you by email at least 30 days before Pro starts costing money, and your account then moves to the Free plan unless you choose to upgrade. Nothing is charged automatically.

5. Paid plans and refunds

Paid plans are not on sale yet. When they launch, this section applies to them, and the price, billing period and taxes will be shown to you before you pay.

• Billing. Fees are paid in advance through our payment provider. Monthly and yearly subscriptions renew automatically at the end of each period until you cancel. Before you subscribe we show the renewal price and how to cancel.
• Cancelling. You can cancel at any time in your account, without contacting us. Cancelling stops the next renewal; you keep paid features until the end of the period you have paid for.
• Price changes. We tell you at least 30 days before a new price applies to your subscription. The new price applies from your next renewal, and you can cancel before then.
• Failed payments. If a renewal cannot be charged, your account moves to the Free plan. Your account and saved data are not deleted for this reason.
• 7 day money back. If you are not happy with your first purchase of a paid plan, email us within 7 days of paying and we refund it in full, with no questions asked. This applies once per person and not to renewals.
• Right of withdrawal. If you are a consumer in the EU, the EEA or the UK, you may also withdraw from a paid plan within 14 days of buying it without giving a reason. Because you ask us to start the Service straight away, we may keep an amount in proportion to the time you used before withdrawing. Email us to withdraw.
• Other refunds. Apart from the cases above and your rights under the law, fees already paid are not refundable. Accounts closed for a serious breach of these terms are not refunded.

6. Fair play at the tables

Omahalytics is for study away from the table. You must not use the Service during a hand or session you are playing, live or online, and you must not use it in any way that breaks the rules of a poker site, club or tournament you play in. Many poker sites treat real time assistance as cheating and close accounts for it.

If we have reasonable grounds to believe that you use the Service for real time assistance, we may suspend or close your account.

7. Acceptable use

You may use the Service for your own study, personal or professional. You must not:

• use bots, scripts, scrapers, headless browsers or any other automated means to access the Service, or call its interfaces other than through the app, unless we offer an official API and you use it within its terms;
• copy or extract the hand rankings, results or other data in bulk, or rebuild them into a database, ranking file or chart pack;
• resell, sublicense or publish access to the Service or its output as a product, or use it to build a competing product or to train a machine learning model;
• use one account to serve students, a stable, a group or a coaching business; each person needs their own account;
• get around limits, quotas or security measures, for example with extra accounts, shared accounts or rotating addresses;
• reverse engineer, decompile or probe the Service, except where the law allows it despite this restriction;
• overload, disrupt or attack the Service, or upload anything harmful or unlawful;
• use the Service for anything that breaks the law where you are.

Quoting individual results in posts, articles or coaching material is fine, as long as you name Omahalytics as the source.

8. Shared links

Where your plan includes shared links, you can turn a finished simulation into a link. A shared link is a read only snapshot that anyone with the link can open, without an account. Share links only with people you choose, and do not put personal data in the ranges or labels you share.

Links made on a Pro plan are kept for one year from the day they were created and then removed. You can delete your own links at any time. We may remove a link that breaks these terms or the law.

9. Results, accuracy and responsible play

Range vs range equities are Monte Carlo estimates: they come from a sample of deals and are shown with a 95% confidence interval, so the true value can lie outside the figure shown. Hand rankings are computed by full enumeration. We test the Service carefully, but software can contain errors, and we do not promise that every result is free of them.

The Service gives information for study. It is not financial, betting or professional advice, and it does not guarantee that you will win. How you play and what you risk are your decisions and your responsibility.

Poker involves real money risk. Play only where it is legal for you, and only with money you can afford to lose. If gambling stops being fun for you or someone you know, free and confidential help is available from Gambling Therapy and from national helplines.

10. Intellectual property

The Service, its software, hand rankings, data, design and the Omahalytics name and logo belong to us or our licensors. We give you a personal, non exclusive, non transferable and revocable licence to use the Service under these terms while your account is active. No other rights pass to you.

The ranges, boards and settings you enter remain yours. You let us store and process them as needed to run the Service for you, and to show them to the people you send a shared link to. If you send us feedback or ideas, we may use them freely and without payment.

11. Availability and changes to the service

The Service is still being developed and changes often. We work to keep it running but cannot promise that it is always available, fast or uninterrupted; maintenance, updates and problems at our hosting or network providers can cause downtime. Please keep your own copy of anything you need, since saved runs and links are not guaranteed to be backed up.

We improve the Service over time and may add, change or remove features. If we stop offering a paid plan before the end of a period you have paid for, we refund the unused part.

12. Suspension and termination

You can stop using the Service and delete your account at any time. Deleting your account removes your saved data and shared links, apart from records we must keep by law.

We may suspend or close your account if you break these terms, if the law requires it, or if your use puts the Service or other users at risk. Where reasonable we warn you first and give you a chance to respond; for automated access, real time assistance, fraud or attacks we may act straight away. If we close your account without a breach on your part, we refund any unused prepaid fees.

Sections 7, 9, 10, 13 and 17 continue to apply after your account ends.

13. Liability

Free use. When you use the Service without paying, on the Free plan or on Pro while it is offered at no cost, it is provided free of charge "as is" and "as available", without warranties of any kind, and we are not liable for any loss arising from your use of the Service or your inability to use it.

Paid plans. Apart from what these terms and the law require, a paid plan is provided "as is" and "as available", without further warranties. We are not liable for indirect or consequential loss, or for lost profits, winnings, stakes or data, arising from your use of the Service or your inability to use it. Our total liability to you for all claims is limited to the total you have paid us or 100 US dollars, whichever is lower.

Nothing in these terms limits liability that cannot be limited by law, including liability for intent or gross negligence and under data protection law, and nothing affects your statutory rights as a consumer, including your rights when a paid plan does not conform to the contract.

If you use the Service in breach of these terms and a third party claims against us because of it, you agree to cover our reasonable losses and costs, to the extent the law allows.

14. Privacy

Our Privacy Policy explains what personal data we collect and how we use it. In short: we keep your account details and usage records (for example run counts, times and network addresses) to provide the Service, enforce plan limits and detect abuse. We do not sell your data.

15. Complaints

If something does not work as it should, email us at support@omahalytics.com with your account email, a description of the problem and what you would like us to do. We reply within 14 days.

If you are a consumer and we cannot agree, you may contact a consumer protection body in your country, such as a local consumer ombudsman or an out of court dispute resolution body. Consumers in the EU can find these bodies through the European Commission's consumer protection pages. This does not affect your right to go to court.

16. Changes to these terms

We may update these terms, for example when we add features or paid plans, or when the law changes. For changes that affect your rights, we email you at least 30 days before they take effect. If you do not agree, you can close your account before that date, and we refund any unused prepaid fees. If you keep using the Service after the date, the new terms apply.

Small changes that do not affect your rights, such as corrections or new contact details, apply as soon as we publish them. The date at the top of this page shows the latest version.

17. Governing law and disputes

These terms are governed by the law of Poland, and the courts of Poland have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country.

If any part of these terms is found invalid, the rest stays in force. If we do not enforce a right straight away, we do not give it up. You may not transfer your account or these terms to anyone else; we may transfer them to a company that takes over the Service, and your rights under these terms stay the same.
